New fire protection legislation in the form of the Regulatory Reform (Fire Safety) Order was introduced in 2006 and applies to all non-domestic premises in England and Wales. It puts responsibility for fire safety very firmly on the shoulders of business owners, who have a duty of care to employees and visitors alike. Premises must be assessed for their fire risk and a responsible person, in reality the business owner, must be appointed to ensure that all aspects of the law are implemented. In essence, the new rules require a business owner to have a considerable depth of fire safety knowledge and commitment, because there are no more routine visits from the local fire service. Fire certificates ceased to have legal status with the introduction of the new legislation. Premises must be properly protected, with fire safety equipment to deal with an outbreak of fire, so buildings need a safe and properly maintained means of escape, fire extinguishers, signs and notices, emergency lighting, a fire alarm and fire doors. The first step is to carry out a risk assessment of the premises and a review of business practices to identify fire hazards and employees whose jobs put them particularly at risk. Next, a detailed plan is produced as the basis for implementing fire safety policies and procedures. The business may need to buy additional fire protection products and will need to set up and keep proper records of fire procedures, including evacuation of the premises, staff training and fire drills. Few small businesses are likely to have all the necessary specialist knowledge and expertise in house for a fully comprehensive fire policy, if they are aware of the regulations at all. Indeed, recent research has revealed a shocking level of ignorance – in excess of 40%* - among business owners, which means that many companies simply do not comply with the law. Whilst companies can access a wealth of free information and download a variety of advice documents**, many prefer to commission a specialist in the field to do the assessment, train staff and advise on equipment. Many businesses, large and small, are finding that high-quality fire extinguishers, safety signs, alarm equipment and many more fire safety items are being sold on the internet at a fraction of their traditional prices. This is making it easier for businesses to comply with the law without the huge expense normally associated with fire protection equipment. Ensure any fire protection products you buy carry the appropriate quality labeling which may include BSI Kitemark, CE mark and various UK industry-standard approvals such as BAFE where available. Remember to cover all the risks that your business could encounter.
